Man sentenced to 5 years in drug case

A Coldiron man was sentenced to five years in prison Thursday in Harlan Circuit Court. He was recently arrested in a drug raid.

Freddie L. Simpson, 54, was arrested on Oct. 3, 2005, on charges of first-degree trafficking a controlled substance and being a persistent felony offender. He pleaded guilty in July 2006 to an amended charge of possession of a controlled substance and second-degree being a persistent felony offender and sentenced to a pre-trial diversion. He was granted three years probation subject to adhering to all conditions of drug court, a program he was given the chance to complete.

Everything changed for Simpson when he was arrested July 8 by the Harlan County Sheriff's Office and charged with first-degree trafficking a controlled substance and third-degree trafficking a controlled substance following a raid on his residence.

As a result of the search, 47.5 OxyContin 80 mg pills, three Xanax pills and $5,788 in cash were confiscated. Two vehicles, a Mercury SUV and a 2005 Saturn, and a a BMX 110cc ATV were also seized.

Simpson, who has been in jail since his most recent arrest, appeared in circuit court Thursday before Judge Russell Alred to be sentenced in his 2005 case. Simpson's attorney requested that the sentencing be postponed. Alred denied the request. Simpson's pre-trial diversion was set aside and he was sentenced to five years.

In other court action:

-- Pam Marsee, 40, was sentenced to 10 years on drug charges.

-- Vanessa Kyle, 54, was sentenced to one and half years on drug trafficking charges.

-- Clarence Earl Deal Jr., 22, was sentenced to two years on charges of unlawful transaction with a minor.

-- Jackie McMillian, 42, was sentenced to five years on a theft charge. She was also ordered to pay $28,000 in restitution at no less than $150 per month after she is released from prison.

-- Kenneth Clem, 51, was sentenced to one year in prison on a drug trafficking charge, which was pre-trial diverted for two years.

-- Melvin Day, 26, was sentenced to one year, and his pre-trial diversion was set aside.

-- Jennifer Witt, 24, was sentenced to one year on an accomplice to theft by unlawful taking charge.

-- Mary Caldwell, 40, was sentenced to one year. The sentence is to run consecutive with other time she's serving.

-- Randall Cottrell, 20, was sentenced to five years on a drug charge.

-- Michael Earls, 23, was sentenced to 10 years on drug trafficking charges.

-- Debra Greene, 30, was sentenced to five years on a drug trafficking charge.

-- Dennis Vick, 43, was sentenced to five years on drug trafficking charges.

-- Sherry Williams, 53, was sentenced to three years on a drug charge.

-- Danny Sharp, 22, was sentenced to six years on drug trafficking charges.

-- Rick Thornsberry, 36, was sentenced to one year on a drug charge.

-- Annette Turner, 42, was sentenced to eight years on drug trafficking charges.

-- Wendy Varner, 31, was sentenced to five years on drug trafficking charges.

-- Eva Cook, 30, was sentenced to five years on a drug trafficking charge.

-- Eddie Niece, 34, pleaded not guilty to a charge of first-degree trafficking a controlled substance.

-- Phillip D. Coleman, 44, pleaded not guilty to two counts of fraudulent use of credit cards over $100 within a six-month period.

-- Billy R. Robbins, 51, appeared for a probation revocation hearing. Following the hearing, his probation was revoked.

-- Tonya Dixon, 29, appeared for a probation revocation hearing. She did not contest the revocation.

-- Mary Gray, 41, was scheduled for a shock probation hearing. Shock probation was denied.
