Harlan County Sheriff's Deputy Edward Abner arrived at the home of Kelly A. York, 19, of Mastin Drive in Cumberland, to serve two warrants for failure to appear in court for theft by deception charges.
While at the complex, Abner discovered James E. McMillion, 26, of Billy G. Hollow in Tremont, hiding under a bed in one of the apartments.
According to Abner, McMillion had been warned in writing to stay away from the property in the past.
McMillion was charged with second-degree criminal trespassing and lodged in the Harlan County Detention Center.
York was taken into custody and charged with two counts of failure to appear.
Abner was assisted in both arrests by Cumberland Police Chief Derrick Akal.

n Justin Ray Williams, 20, of Cranks, was charged with operating on a DUI-suspended license, failure to register transfer of a motor vehicle, no head gear, no insurance, no motorcycle insurance, no registration receipt, no registration plates and speeding. Bond was set at $10,000.
n Evie Don Cox, 48, of Putney, was charged with driving under the influence (second offense). Suspect was released on their own recognizance.
n Rettie D. Morris, 31, of Grays Knob, was charged with driving on a DUI-suspended license. Bond was set at $2,000.
n James Daniel Richards, 30, of Cawood, was charged with driving under the influence, failure to wear a seat belt, no insurance and one headlight. He was fined and released.
n Homer T. Sharp, 24, of Whitesburg, was charged with driving under the influence and no insurance. He was released on his own recognizance.
n Teddy Andrew Smith, 20, of Wallins, was charged with tampering with physical evidence and theft by unlawful taking. Bond was set at $10,000.
n Antonia C. Alred, 28, of Wallins, was charged with driving under the influence (second offense) and operating on a suspended license. Bond was set at $10,000.
n Nancy Bailey, 55, of Wallins, was charged with driving under the influence, failure to produce insurance card and no registration receipt. She was released on her own recognizance.
n Nancy Bailey, 55, of Wallins, was charged perjury. Bond was set at $15,000.
n Nancy Bailey, 55, of Wallins, was charged with violation of a domestic violence order. No bond was issued.
n Ricky L. Bingham, 44, of Harlan, was charged with alcohol intoxication, disorderly conduct, resisting arrest and terroristic threatening. He was released on his own recognizance.
n Rostin Bray Jr., 57, of Cawood, was charged with driving under the influence, failure to produce insurance card, failure to wear seat belt, no horn, no insurance, no operator's license, no registration receipt, no tinting label on vehicle, no turn signal, obstructed window, operating on a suspended license and excessive window tinting. He was released on his own recognizance.
n Seth Brock, 18, of Wallins, was charged with driving under the influence (second offense), license not in possession and no tail lamps. He was released on his own recognizance.
