A Harlan man is facing multiple charges including resisting arrest and possession of marijuana following an alleged incident on Pope Hill.
Daniel R. Bustle, 36, was arrested by Kentucky State Police Trooper Jared Boggs on Wednesday.
According to the citation, Bustle was standing in the road leaning into the window of a vehicle talking to the driver. The occupants of the vehicle were the male driver and a female passenger. When Boggs approached, he saw something in Bustle’s hand. Boggs identified himself as Kentucky State Police and advised the the three individuals to put their hands on their heads. Bustle refused to do so, also refusing further verbal commands. Boggs then placed Bustle on the ground. Once he was on the ground, Bustle refused to put his hands behind his back.
The citation states once police got handcuffs on Bustle, he reached into his back pocket and pulled out a small container. He then threw the container over into some nearby weeds in an attempt to hide evidence. Police retrieved the container and found it contained suspected narcotics. He also had suspected narcotics in his pants pocket. Bustle had another metal container his pocket containing what he said was one marijuana joint. Bustle was manifestly under the influence of drugs or narcotics at the time.
Bustle was charged with public intoxication by a controlled substance (excludes alcohol), tampering with physical evidence, prescription controlled substance not in original container, resisting arrest, possession of marijuana, third-degree trafficking a controlled substance and failure to notify address change to department of transportation.
He was lodged in the Harlan County Detention Center on a $10,000 full cash bond.
