A man and woman are facing manslaughter indictments stemming from the April death of a child.
Dallas Kelly, 32, and Tabatha Philpot, 22, were arrested on indictment warrants on Monday. Kelly and Philpot were both indicted for second-degree manslaughter.
According to the indictments handed down by the grand jury on Aug. 29, Kelly and Philpot caused the death of a person under the age of 8 on April 4 when they left a child unattended in a bathtub. The indictments state the pair “manifested extreme indifference to human life, and created a grave risk of death to the child, thereby causing the death of the child.”
Kentucky State Police Det. Josh Howard presented the evidence to the grand jury resulting in the indictments.
Kelly was arrested on an indictment warrant by Harlan City Police Sgt. Jeff Owens and lodged in the Harlan County Detention Center.
Philpot was arrested on an indictment warrant by Kentucky State Police Trooper Jake Spurlock and lodged in the Harlan County Detention Center.
In other police activity:
• Ruth Tolliver, 42, of Evarts, was arrested on an indictment warrant by Evarts City Police Officer Joseph Jones on Friday.
According to the indictment handed down by the grand jury on June 1, 2015, Tolliver knowingly possessed oxycodone on or about Sept. 21, 2013. The indictment also states she was under the influence of a controlled substance on the same day.
Former Evarts City Police Officer John Teagle presented the evidence to the grand jury resulting in the indictment.
Tolliver was indicted for first-degree possession of a controlled substance, possession of drug paraphernalia and public intoxication. She was lodged in the Harlan County Detention Center on a $2,500 surety bond;
• Ariel Henry, 23, of Cumberland, was arrested for a probation violation by Probation and Parole Officer Adam Brock on Monday. She was lodged in the Harlan County Detention Center.
